Information We Collect and How We Collect It
We collect several types of information from and about users of our Websites and products and services and those individuals that interact with us. We collect information: (i) by which you may be personally identified, such as name, postal address, e-mail address, telephone number, personal preferences, credit card information, including billing address, or any other identifiers by which you may be contacted online or offline; (ii) that is about you but individually does not identify you, such as IP address or other online identifiers; and/or (iii) about your internet connection, the equipment you use to access our Websites and usage details (collectively, "Personal Data").

Information We Collect Through Automatic Data Collection Technologies:

Pixel tags also enable us to send you e-mail in a format you can read and let us know when you have opened an e-mail message from us.

We may use third party companies to provide advertising services and/or to collect certain information when you visit and interact with our Websites. These third-party companies may collect and use non-personally-identifiable information (e.g., click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) during your visit to our Websites in order to provide advertisements about goods and services likely to be of greater interest to you and for our business purposes, including but not limited to research and analytics, product promotions, and website management.  These third-party companies may use cookies and other technologies to recognize your browser to collect and record information about your web surfing activity including your activities on the Websites. This information may include, without limitation, the pages you viewed, how long you spent on each page, and how you interact with particular webpages via input devices.  These technologies may be used directly on this website. Information From Third Parties

We may receive information about you from other sources, including data vendors, data co-ops, marketing partners, and anti-fraud services. We may add this information to the information we have already collected from you to use for all the purposes described in the privacy policy.

In addition, we may gather information about you from external sources, which includes Personal Data obtained from social media platforms and data co-ops, such as name, email address, friend list, photo, age, gender, location, birthday, social networking ID, current city, your comments about our Services, and the people/sites you follow. In addition, we may utilize the Google Maps service and other comparable services to acquire geolocation data. This information is used to simplify the checkout process by suggesting shipping and billing addresses, or locating the nearest store. Please note that the Google Maps service adheres to Google's privacy policy as outlined on www.google.com/policies/privacy. Our collection of Personal Data from Facebook or other social media platforms is subject to their terms of use and privacy policy and your social media settings. Finally, we procure and exchange contact information, demographic information, commercial information, and internet and electronic activity with third-party data aggregators and data co-ops.

How We Use Your Information

Disclosure of Your Information
We may disclose Personal Data that we collect or you provide as described in this privacy policy:

Special U.S. Privacy Information
Some of the Personal Data we collect information constitutes "personal information" under the California Consumer Privacy Act of 2018 ("CCPA") and the California Privacy Rights Act of 2020 ("CPRA") or "personal data" under the Virginia Consumer Data Protection Act ("VCDPA"), the Colorado Privacy Act ("ColoPA"), the Connecticut Act Concerning Personal Data Privacy and Online Monitoring ("CTDPA"), Utah Consumer Privacy Act ("UCPA"), or other similar state laws.

In particular, within the last twelve (12) months, we collected (whether directly, indirectly (e.g., by observing your actions on our Websites) or from third parties) the categories of Personal Data, which constitute "personal information" under the CCPA and CPRA or "personal data" under the VCDPA, ColoPA, CTDPA, UCPA or other similar state laws, listed in the table below. Any such collection has been for of the purposes included in the appropriate section of the How We Use Your Information section above and from the sources included in the appropriate section of the Information We Collect and How We Collect It section above.

For the purposes of this Section, Personal Data does not include publicly available information from government records, lawfully obtained, truthful information that is a matter of public concern, deidentified or aggregated consumer information or information specifically excluded from the scope of applicable data protection laws, such as health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data or other biomedical research study or personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), the Federal Farm Credit Act of 1971, and the Driver's Privacy Protection Act of 1994.

We have not sold any Personal Data of consumers in the last 12 months. We have not collected any "sensitive personal information" under the CCPA and CPRA or "sensitive data" under the VCDPA, ColoPA, CTDPA, UCPA or other similar state laws in the last 12 months.

We will retain your Personal Data for the period necessary to fulfill the purposes outlined in this Privacy Notice unless a longer retention period is required or allowed by law.

The criteria used to determine our retention periods include:
  -  The length of time we have an ongoing relationship with you and provide requested services to you;
  -  Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them);or
  -  Whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).

We may disclose your Personal Data to a third party for a business purpose. When we disclose Personal Data for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that Personal Data confidential and not use it for any purpose except performing the contract. We have disclosed this Personal Data for a business purpose to the following categories of third parties:
  -  contractors, service providers, and other third parties we use to support our business, such as email service providers, payment processors, and shipping carriers.
  -  consumer relations, including consumer complaint response services;
  -  employee recruitment, career portal and job applicant services; and
  -  legal representation, including with regard to prevention harm to our company, its subsidiaries, our products or services or a person or property (e.g., fraud prevention).

We may "share" your Personal Data with third parties. As used herein, "share" refers to sharing for purposes of cross-context behavioral advertising or targeted advertising, as contemplated under applicable law, such as the CPRA, VCDPA, ColoPA, CTDPA, and UCPA. Applicable law prohibits third parties who receive the Personal Data from resharing it unless you have received explicit notice and an opportunity to opt-out of further sharing.

We share your Personal Data with the following categories of third parties for cross-context behavioral advertising:
  -  Advertisers.
  -  Social media companies.

As applicable, certain state privacy laws, such as the CCPA, CPRA, ColoPA, VCDPA, CTDPA, and UCPA provide their residents, respectively, with specific rights regarding their Personal Data.

A.    Access to Specific Information and Data Portability Rights.  You have the right to request that we disclose certain information to you about our collection and use of your Personal Data. Once we receive and verify your request (please see Subsection Exercising Access, Data Portability, Correction, and Deletion Rights below for more information), we will disclose to you, as applicable:
  -  The categories of Personal Data we collected about you.
  -  The categories of sources for the Personal Data we collected about you.
  -  Our business or commercial purpose for collecting or sharing that Personal Data.
  -  The categories of third parties with whom we disclose that Personal Data.
  -  The specific pieces of Personal Data we collected about you (also called a data portability request).
  -  If we sold or disclosed your Personal Data for a business purpose, two separate lists disclosing:
         
  -  the Personal Data categories that we sold and for each category identified, the categories of third parties to whom we sold that particular category of Personal Data; and
            - the Personal Data categories that we disclosed for a business purpose and for each category identified, the categories of third parties to whom we disclosed that particular category of Personal Data.

B.    Correct Specific Information.  You may have the right to request that we correct inaccurate Personal Data about you. Once we receive and verify your request (please see Subsection Exercising Access, Data Portability, Correction, and Deletion Rights below for more information), we will use commercially reasonable efforts to correct the information to comply with your request. This right is not afforded to residents of Utah under the UCPA.

C.    Deletion Request Rights. You have the right to request that we delete any of your Personal Data that we collected from you and retained, subject to certain exceptions. Once we receive and verify your request (please see subsection Exercising Access, Data Portability, Correction, and Deletion Rights below for more information), we will delete (and direct our service providers to delete) your Personal Data from our records, unless an exception applies. In responding to your request, we will inform you whether or not we have complied with the request, and, if we have not complied, provide you with an explanation as to why.

We may deny your deletion request if retaining the information is necessary for us, or our service provider(s), to:
  -  Complete the transaction for which we collected the Personal Data, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  -  Help to ensure security and integrity to the extent the use of your Personal Data is reasonably necessary and proportionate for those purposes.
  -  Debug products to identify and repair errors that impair existing intended functionality.
  -  Exercise free speech, ensure the right of another consumer to exercise his/her free speech rights, or exercise another right provided for by law.
  -  Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  -  Engage in public or peer-reviewed scientific, historical, or statistical research that conforms or adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the ability to complete such research, if you previously provided informed consent.
  -  Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us and compatible with the context in which the you provided the information.
  -  Comply with a legal obligation.

D.    Personal Data Sharing Opt-Out and Opt-In Rights.
Pursuant to applicable law, you have the right to direct us to not share your Personal Data at any time (the "right to opt-out"). As used herein, "share" refers to sharing for purposes of cross-context behavioral advertising or targeted advertising, as contemplated under applicable law, such as the CPRA, VCDPA, ColoPA, CTDPA, and UCPA.

We do not have actual knowledge that we share the Personal Data of consumers under 16 years of age. We will not share the Personal Data of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to Personal Data sharing may opt-out of future sharing at any time.

You may also exercise the right to opt-out using an opt-out preference signal in a format commonly used and recognized by businesses, such as through an HTTP header field. When we receive an opt-out preference signal, we will treat it as a valid request to opt-out of the sharing for that browser or device sending the signal, and, if known, for the consumer.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize Personal Data sharing. However, you may change your mind and opt back in to Personal Data sharing at any time by sending us an email to soft_surroundings@softsurroundings.com.
You do not need to create an account with us to exercise your opt-out rights. We will only use Personal Data provided in an opt-out request to review and comply with the request.

E.    Exercising Access, Data Portability, Correction and Deletion Rights.  To exercise the access, data portability, correction, and deletion rights described above, please submit a consumer request to us through one of the following:
  -  Calling us at 1-800-540-7076.
  -  Emailing us via https://www.softsurroundings.com/emailus/.

When you use a request method above, we may request certain information for verification purposes, such as your name, address, and e-mail address. We will use this information to verify this is a permitted request, such as by matching your name and address with information in our records. Depending on the type of request, we may require a certain number of data points to allow for verification.

Only you, or a person properly authorized to act on your behalf, may make a consumer request related to your Personal Data. You may also make a consumer request on behalf of your minor child, as applicable.

An authorized agent may make a request on your behalf using the request methods designated above. Additionally, if you use an authorized agent to submit a consumer request, we may require the authorized agent to provide proof that you gave the agent signed permission to submit the request. We may also require you to verify your own identity directly with us or directly confirm with us that you provided the authorized agent permission to submit the request.

You may only make a consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
  -  Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data or an authorized agent of such person.
  -  Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you.

Making a consumer request does not require you to create an account with us.

We will only use Personal Data provided in a consumer request to verify the requestor's identity or authority to make the request.

If we deny your request, you may have the right to appeal our decision under certain laws. Further, if you appeal and your appeal is denied, you may the right to complain to your state's attorney general. You may appeal your decision by contacting us at soft_surroundings@softsurroundings.com.

F.    Response Timing and Format.  In accordance with applicable law, we endeavor to respond to consumer requests within forty-five (45) days of its receipt. If we require more time (up to 45 additional days), we will inform you of the reason and extension period in writing. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Data that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

G.    Non-Discrimination. We will not discriminate against you for exercising any of your rights. Unless permitted by applicable laws, in connection with you exercising your rights, we will not:
  -  Deny you goods or services.
  -  Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  -  Provide you a different level or quality of goods or services.
  -  Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by applicable laws that can result in different prices, rates, or quality levels. Any legally-permitted financial incentive we offer will reasonably relate to your Personal Data's value to us and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

H.    Other California Privacy Rights. California Civil Code Section § 1798.83 permits California residents to request certain information regarding our disclosure of personal data to third parties for their direct marketing purposes.
